Construction & Demolition Recycling
The City of Oakland’s Construction and Demolition Debris Waste Reduction and Recycling Ordinance (C&D Recycling Ordinance) is part of the City’s efforts to meet local and State mandated requirements to divert materials from landfill disposal, including Oakland’s goal of Zero Waste by 2020.
Non-Exclusive Franchise Required to Haul Construction & Demolition Debris in Oakland - Effective July 1, 2015, parties collecting, transporting or disposing of construction and demolition (C&D) debris are required to obtain a Non-Exclusive Franchise (NEF) issued by the City.

C&D Recycling Ordinance Requirements
The City of Oakland requires projects subject to the C&D Recycling Ordinance (affected projects) to recycle:
- 100% of all Asphalt & Concrete (A/C) materials, and
- 65% of all other materials
Affected Projects (Effective 1-1-14 per OMC 18.02.100)
- All New Construction
- All Mixed Use Alterations
- All Historic Resource Removal
- Demolition (except Single Family Dwellings)
- Additions and Alterations:
- Single Family Dwellings; Duplex Conversion: Increase in volume or conditioned space
- Non-Residential Construction: Valuation of $50,000 or greater; scope of 1000 square feet or more
- Projects with Design Review & Landscape Plan: Total floor area of 500 square feet or more
Required Forms for Affected Projects
- A Waste Reduction and Recycling Plan (WRRP) that shows how the project will salvage and/or recycle 100% of asphalt & concrete debris, and at least 65% of all other materials.
- A Construction and Demolition Summary Report (CDSR) that documents the actual salvage, recycling and disposal activity for the completed project.
*Fees apply for all paper or non-Green Halo submittals and start at $232.27 for projects started after May 2011.
Fees apply for same day review of WRRPs or CDSRs and start at $375.00 per submittal.
Online Submission Process
The City introduced Green Halo Systems in May of 2011 as the standard method for submittal of WRRPs and CDSRs online, replacing paper forms. There are no costs for using Green Halo for online submissions.
Use of Green Halo Systems for projects in the City of Oakland requires an access code issued by the City.
When filing a building permit application, please complete the Construction and Demolition (C&D) Receipt. Keep the portion designated APPLICANT COPY.
There are five steps for completing WRRPs and CDSRs online:
Step 1 – Add GreenHaloSystems.com to your email safe sender list to prevent messages being treated as junk.
Step 2 – Log on to www.greeenhalosystems.com and create a new recycling plan, OR (for new users), reate a profile at www.greenhalosystems.com, activate your account, then follow the link in the email from Green Halo to start a new project.
Step 3 - Complete and submit a WRRP online prior to issuance of building permit.
Step 4 – Upload receipts, invoices, photos, or other relevant documentation as you go. Do not wait until the finish of the project to upload.
Step 5 – At project completion, click “Submit For Final” to deliver a completed CDSR to the City, prior to scheduling the Final Inspection or requesting a T.C.O. or C.O.. Failure to do so may result in delays in scheduling.
Fees apply for paper submittals and start at $232.27 for projects started after May 2011. There is no cost for online submissions via Green Halo.

Step 2 – Pay fees for paper submittals. Permit Counter staff will notify Applicants of fees due prior to issuance of permit.
Step 3- Gather and organize receipts, invoices, photos and other relevant documentation in preparation for the CDSR.
Step 4 – Complete and submit a CDSR at project completion, prior to scheduling the Final Inspection or requesting a T.C.O. or C.O.. You may submit CDSRs at the Building Inspections counter, 250 Frank H. Ogawa Plaza, 2nd Floor, or during office hours at the Green Building Resource Center, 250 Frank H. Ogawa Plaza, 2nd Floor.
Step 5 – Maintain copies of the CDSR and all documentation. Per OMC 15.34, the City may audit your files up to a year after completion of the project.

Rules for Transporting C&D Debris
Parties collecting, transporting or disposing of construction and demolition (C&D) debris are now required to obtain a Non-Exclusive Franchise (NEF) from the City of Oakland, including demolition contractors and sub-contractors, and parties collecting, transporting or disposing of C&D debris using fixed body trucks, trailers or debris boxes, except:
- A party collecting and transporting C&D materials salvaged for reuse and donated by the property owner or contractor.
- The property owner or full-time employee of the property owner using the property owner’s equipment to collect and transport C&D debris.
- A construction contractor performing construction work whose collection and transport of C&D debris is incidental to the construction work, provided that the contractor uses their own fixed-body trucks and employees for the collection and transportation of the C&D debris, and collects and transports the C&D debris at no additional or separate fee. This “incidental” provision does not apply to demolition contractors and sub-contractors.
- A party collecting source separated commodities, separated on the job site, for recycling.
Parties collecting and transporting C&D debris in violation of the Oakland Municipal Code may be subject to City enforcement actions.
